Redkite Secures Significant Settlement in Complex Long Covid High Court Claim
A former teacher has secured a substantial six-figure settlement following a hard-fought High Court claim arising from the onset of Long Covid during the earliest stages of the Covid-19 pandemic.
A Challenging Long Covid Case
Ms M was working as a primary school teacher in March 2020 when she became seriously unwell with Covid-19. Ms M alleged she caught Covid from her visibly feverish and coughing headmaster when he called her and two colleagues into an office for a meeting at the start of a school day. What initially appeared to be an acute illness developed into persistent and life-changing symptoms that continue to affect her daily life more than six years later.
Before becoming ill, Ms M was a wife, mother and dedicated teacher who was actively progressing her career in education. She had ambitions for further professional development and leadership roles within teaching. Instead, she found herself facing chronic fatigue, debilitating migraines, widespread pain, cognitive difficulties, reduced stamina and ongoing health problems that fundamentally changed the course of her life.
In her evidence, Ms M described the frustration of struggling with memory and concentration, the impact of "brain fog", and the loss of independence caused by her condition. Activities many people take for granted became increasingly difficult. Family life was affected, social activities became limited, and even routine tasks required careful planning and management.
Despite the profound effect the illness had on Ms M and her family, her claim was strongly contested throughout.
Disputed Liability, Causation and Limitation
The Defendant denied liability and challenged multiple aspects of the case. The litigation involved complex disputes over whether Ms M contracted Covid-19 from the workplace exposure she alleged, whether the timing of her symptoms was consistent with that exposure, whether her ongoing condition was caused by that infection, and whether she would have developed Long Covid in any event following subsequent Covid-19 infections later in the pandemic.
The Defendant also raised limitation arguments and relied upon extensive factual and medical evidence from an infectious disease consultant in support of its defence.
These issues created significant hurdles in what was widely regarded as a particularly difficult and unusual claim. When Ms M initially sought legal assistance, she was unable to obtain support through her trade union and found it difficult to secure representation elsewhere because of the novel legal and medical issues involved.
The Road to Trial
Phillip Gower, Partner in Personal Injury & Industrial Diseases at Redkite, agreed to act for Ms M and supported her through several years of litigation, gathering extensive witness and expert evidence in preparation for trial.
The case ultimately proceeded to a three-day trial at the Royal Courts of Justice.
Settlement Achieved During Trial
On the first day of trial, Ms M gave evidence about the devastating impact Long Covid had had on her health, family life and future. Before the Defendant's witnesses were called to give evidence, the parties reached agreement and the claim settled for a substantial six-figure sum.
Although the settlement was achieved without any admission of liability, it brings to an end years of uncertainty and litigation for Ms M and her family.
Phillip Gower, Partner in Personal Injury & Industrial Diseases at Redkite Solicitors, said:
"This was an exceptionally challenging case involving a number of difficult factual, medical and legal issues. The claim faced significant hurdles throughout and was vigorously defended. However, at the heart of the case was a client whose life had been fundamentally altered by illness. Ms M showed remarkable determination over many years and we are delighted to have helped secure this outcome for her."
The settlement represents the culmination of years of perseverance by Ms M and highlights the importance of specialist legal representation in complex and novel cases, even where others may consider the obstacles too great to overcome. This is now Redkite’s third six-figure Covid settlement.
