Personal Injury FAQ

How long do I have to make a claim?

If you suffered an injury through no fault of your own, it’s likely you’ve considered claiming for compensation. Whether it’s a road traffic accident, a serious work related injury or a case of clinical negligence, there is three-year limitation period in which you can come forward and make your claim.

For personal injury claims made by children, the time limit is still three years, however this period will not begin until the child reaches the age of 18. There are also slightly different time limits on cases where the injured party does not have mental capacity (ie the ability to make decisions for themselves for some reason).

For compensation claims regarding criminal injuries, there is a two-year time limit for you to bring forward your application to the Criminal Injuries Compensation Agency (‘CICA’). However, when dealing with historic sexual abuse cases, the CICA will accept claim applications outside of this two year period.

What is a No Win-No Fee Agreement?

If you wish to make a personal injury claim but are concerned about finances, speak to your solicitor about making a no win-no fee claim. This type of claim allows all Claimants a fair chance of obtaining compensation regardless of their financial situation. Simply put, if we do not manage to secure compensation, you will not be required to pay legal fees. There are no up front costs involved, and you will only be expected to pay the legal fees if the ‘no win-no fee’ claim is decided in your favour and these fees will be made clear to you at the start of your case.

How can I claim for my injury?

The best thing you can do is to contact a specialist personal injury solicitor as soon as possible. After getting in touch with a member of our team and explaining the situation, we will work with you to build your claim by gathering as much evidence as possible to support it.

Prescriptions, medical records and official notes from the doctor who treated you for your injury will all be useful in strengthening your claim. We will also aim to gather statements from witnesses present at the time of your injury and any friends, family members and passers-by who can provide further evidence will also be beneficial.

Once we think your claim is ready, we will submit your case along with all evidence to the person at fault for your injury and their insurers. If they accept they were to blame for your injury (known as liability) a settlement can be negotiated once all evidence in support of your claim is to hand. If liability is denied, we may have to issue Court proceedings so a Judge can decide on who was to blame and how much compensation you should receive.

No matter how challenging matters may become, our personal injury solicitors are with you every step of the way. To make a no win-no fee personal injury claim, get in touch with a member of our team today.
