Transfer of Undertakings Regulations

Many people buying or selling a business fail to consider the implications for the employees already employed by that business. The Transfer of Undertakings (TUPE) regulations may apply in such circumstances.

Getting it wrong is an expensive mistake

Failure to comply with TUPE can be an expensive mistake. A seller is liable for £250 compensation per employee if they fail to provide required information to the buyer at least 28 days before the sale.

A buyer and seller are also jointly liable for failure to inform and consult employees, with compensation set at 13 weeks’ pay per employee. This could be significant dependent on the number of employees involved.
