Restrictive Covenants

Redkite Solicitors receives many enquiries from businesses regarding the enforceability of Restrictive Covenants. For example, your contract might include a clause that states an employee cannot poach your staff and/or clients for several months after they have left employment. Only to find out within a couple of weeks that other members of staff have left to follow this individual and key clients have cancelled their contracts and the ex-employee is now providing those goods or services in competition with your business.

Where Restrictive Covenants are enforceable unfortunately the cost involved prevents businesses taking out injunctions and bringing a claim for damages.
