Brain Injuries and Medical Negligence: Action for Brain Injury Week

21 May 2025

As part of our Action for Brain Injury Week 2025, we are  proud to continue our ongoing support with Headway, which is a UK-wide charity that works to improve life after brain injury by providing vital support and information services https://www.headway.org.uk/.  The theme for this year from Headway is “On a good day. On a good day will tell of the fluctuating and unpredictable nature of brain injury, highlighting the gap between capabilities on a good day versus a bad day.” Every year, thousands of people suffer life-altering brain injuries – and in some instances, those injuries could and should have been avoided.

We at Redkite Solicitors, support individuals and families affected by brain injuries and this week aim to shed light on how these injuries can arise from medical negligence. If you feel you have a claim it is important to seek early legal advice so we can support you during what can be very difficult times.

Brain injuries can occur in the healthcare setting, and there are several contributing factors that we see on a regular basis.

  • Delays in diagnosing or treating a stroke.
  • Mismanagement of head trauma and/or concussion in A&E
  • Anaesthetic errors during surgery
  • Failure to manage oxygen levels during birth or surgery
  • Negligent treatment of infections like meningitis or encephalitis
  • Failing to prescribe medication to prevent blood clots resulting in strokes

When medical professionals fail to meet the standard of care expected of them – and that failure causes or contributes to a brain injury – a claim for clinical negligence may arise.

Brain injuries can have a catastrophic effect on an individual’s standard of life and can affect their cognitive abilities, physical ability and mobility, behaviour, personality and mental health. This may also contribute towards a diminished ability to work or live independently.

Such injuries can have a profound impact on not only the individual but also their family and close relations – we often see family members becoming full time carers, adaptations to their homes being required or long-term therapy requirements. This can carry an enormous amount of emotional and financial burden.

Headway has been vital raising awareness of brain injuries and their impacts and their mission to to promote understanding of all aspects of brain injury and provide information, support and services to survivors, their families and carers. In addition, Headway will campaign to reduce the incidence of brain injury.   Action for Brain Injury week helps to highlight this important charity and their aims.

At Red Kite we understand the importance and impact brain injuries can have and we have specialist brain injury solicitors within our team.  If you need any advice please contact us and we will be able to discuss and guide you.
