We provide the same high-quality advisory service for people who own, or wish to own, an agricultural property. Like commercial property, the agricultural property is a very broad term which includes, agriculture, woodland, wetlands and gardening land. Similarly, commercial property may include land specified for mixed purposes.

At Redkite Solicitors Haverfordwest, we will guide you through, among other things, the often bewildering regulations which affect how much land can be used, inherited, and developed.

What our clients say

I was very pleased with the courtesy of the ladies who attended to my requests and particularly so at the time when I had my accident – they were extremely helpful.

Paul James' support has been invaluable in effectively progressing key contractual requirements. His knowledge and expertise in contract and procurement matters is exceptional. Would not hesitate to engage Paul's services again in future should the requirement and opportunity arise.” (dated March 2017).

The reason I used Redkite is that most solicitors don’t have the area of expertise that I required.

Redkite have provided assistance through several particularly difficult issues. Their advice has been professional, thorough and specifically tailoured to the needs of our business. The staff are approachable, knowledgeable and realistic in the advice they provide.

Redkite were recommended to me and I would do the same, fantastic service.

I have to say that everyone I have come into contact with from the receptionists to the solicitors have always been excellent. The advice I have been given formally and informally has always been clear and concise which is always a weight off your mind when you are dealing with the affairs of your loved ones.

How can our commercial property solicitors help you?

Our dedicated team of commercial property specialists will guide you on the following services:

  • Leases: negotiating and drafting
  • Developments

Leases

Our experts can be trusted to deliver in various areas, such as complex lease negotiations, lease drafting, lease assignments, lease surrenders and lease disputes. We pay attention to detail and will ensure that your understanding of the risks and potential liabilities that may be involved is thorough. A specifically drafted contract makes for a good working partnership between the landlord and the tenant.

Attention to Detail

Attention to detail is critical as is the need to ensure you have a clear view of the associated risks and potential risks. A clearly written contract will enable both landlord and tenant to develop a good professional relationship and achieve this objective at the outset.

Our lease services include:

  • Complex lease negotiations
  • Lease drafting
  • Lease assignments
  • Lease surrenders
  • Disputes over leases

Developments

Our clients also benefit from a property team that can advise on a wide range of issues, from existing property developers and landowners to large land ownership and public bodies.

With a thorough understanding of the commercial environment impacting land purchases, we regularly assist developers in making educated and strategic decisions aimed at improving productivity and returns for investors.

Our development advice covers every aspect of this area of law:

  • Purchase, acquisition and disposal of land for commercial use
  • Sale and lease of commercial property developments
  • Investment advice and property finance
  • Planning permission
  • Portfolio management
  • Licensing

Planning

If you’re unsure if the local planning authority requires permission for the plans or requires disciplinary action, we will help. We have built high-level experience in city and country planning which is unparalleled in Wales.

Challenging Planning Authority Decisions

We can help you contest local planning authority decisions by working alongside local planning experts (and specialist planning solicitor if necessary).

If you are a developer then you are also expected to negotiate a planning agreement with the local planning authority (often recognised as agreements under section 106).  Our advice will be needed to ensure you are realistic about the provisions of those agreements.

We can help you with every facet of planning including:

  • Planning Authority negotiations
  • Agreement and project negotiations, e.g. highways agreements and energy projects
  • Compulsory purchase acquisitions
  • Judicial Review Proceedings
  • Advice on listed buildings
  • Enforcement action advice

Agricultural Land

The agricultural sector is currently a highly regulated environment. For this reason, anyone who runs a farming business will profit from our professional experience, taking them through the legal maze which can be nothing short of the nightmare for an inexperienced person.

Don’t Commit Before Taking Specialist Advice

If you are a landlord or investor the law is complicated and technical, it includes new tenancies for farm businesses.  Do not commit yourself to anything until you receive appropriate advice from our specialist team.

Our business awareness always ensures we’ll assist you when purchasing or selling a property.  We understand the challenges you can face in coping with a wide range of related matters, including long-term experience.

Commercial Property FAQs

Who is responsible for repairing and maintaining commercial property?

A

There will be certain obligations for both the landlord and the tenant when leasing a commercial property. For example, regular checks of health and safety, i.e. gas and electrical equipment, are necessary to ensure that the premise is protected for the business owner. Most commercial landlords will delegate responsibility to their tenant to keep the property maintained to a fair standard in terms of maintenance and repair, thus agreeing to handle the required structural changes. However, that will not necessarily be the case and the actual commercial lease conditions would specify who is liable for the maintenance and repair of the property.

Can I appeal against decisions on planning permission?

A

If your planning proposal is rejected you do have the right to challenge the ruling. However, before filing an appeal, it is a good idea to approach the local planning authority to find out what aspect of your application warranted the rejection, and whether or not those elements could be changed to obtain planning permission. We also suggest that you seek professional legal advice from a member of our team to assist you in appealing the decision, as we will be able to assess the case and support you in rewriting the request.
